Local 1407 member wins $4,000 in arbitration

Local 1407 member Sandra Goldschlager won an arbitration award that will entitle her to an estimated $4,000 in back pay for out-of-title work.

A few years ago, Goldschlager switched her position from Hospital Care Investigator to a Systems Analyst at Coler-Goldwater Hospital.

But although her title changed, the hospital failed to assign her to the new job fulltime. At first, she performed the duties of both positions until her supervisor ordered her to do HCI work full-time.

The HCI position actually pays more than the Systems Analyst job. But Goldschlager, who at the time was a provisional employee, wanted the long-term security of being a permanent Systems Analyst.

Her award covers the difference between the HCI and SA pay rates during the grievance period from Feb. 27, 2012, through Nov. 15, 2013.

"I am very happy with the support I received from the local," said Goldschlager, who now works at Coney Island Hospital.

Inside politics were apparently at the root of Goldschlager's improper assignment. According to Goldschlager, her Systems Analyst responsibilities were assigned to a management crony.

"This case is a good example of teamwork," said Local 1407 Vice President Jed Matalon. Matalon handled the grievance before it went to arbitration, when DC 37 Assistant General Counsel Aaron S. Amaral picked up the case.

Matalon praised Goldschlager for her meticulous documentation. "When a member gets involved so deeply and the local uses all of its available resources, you are usually
on the path to victory," he said.

"We are always prepared to stick with our grievances and build our argument as cases make their way to arbitration," said Local 1407 President Maf Misbah Uddin, who
also serves as DC 37's treasurer. "I am so glad that in this case Sandra is happy with the outcome and doing the job she wants."
